Gustavo Javier Giatti


Gustavo Javier Giatti graduated in 1995 from the Facultad de Derecho de la Universidad de Buenos Aires, and continued his specialization in Corporate Law and Insolvency Law in the same Law School. He has as well as graduate studies in Business Law in Universidad Austral.

His expertise is focused on insolvency law (reorganization procedure, bankruptcy, debt restructuring and pre-pack agreements), environmental law, corporate law, and commercial law litigation.

Regarding reorganization procedures, his experience includes participation in the reorganization proceedings of Suquía, Bisel and Entre Ríos Banks, which became leading cases as the first and only financial entities to have been granted petition for such procedure.

He has also participated in APE and debt restructuring proceedings for Massuh, Agendas Morgan (notebook planners), Frigorífico San Carlos (meat distribution), Rielamericano, Soho (clothing stores), Ventura (electronic retail stores), Ingenio La Esperanza (sugar producer), Naviera Sur Petrolera (O&G), Semillero El Ceibo.

He has represented Banco Patagonia as creditor in a highly complex reorganization proceeding, and acted as counsel for Fideicomiso de Recuperación Crediticia de la Provincia de Buenos Aires in the recovery of its major and most complex credits in the reorganization proceedings of Buyatti, Buyatti, Salpe, Gatic, Showcenter, Tren de la Costa and Sociedad Comercial del Plata.

Currently, he represents Bapro Mandatos y Negocios in the judicial proceeding dealing with the conflict with Coviares S.A., the concessionary company of the Buenos Aires-La Plata highway.

In the area of corporate law, he has represented Telecom Argentina, Sofora Telecomunicaciones, Telecom Personal and Nortel Inversoras in the shareholder conflict that arose in 2008 between Grupo Telecom and Grupo Werthein. He also advises foreign shareholders of the hotel chain Nogaró Buenos Aires / Continental Hotel in a shareholder conflicts with the majority shareholders. He has also a vast experience in M&A, having participated in cases such as Dori Media, Fashion TV and Compañía Azucarera Concepción.

He has acted in complex judicial processes in representation of Nobleza Piccardo, United Airlines, Lan, Banco Platense, Liderar, Jeppesen, Viplan, as well as in a lawsuit against a subsidiary of Meridian Gold. He has participated in the drafting of legal opinions for clients such as Mega, Emepa, Endesa Costanera, Compañía Elaboradora de Productos Alimenticios, Alitalia, Gas Camuzzi, Asics, among others.

In the area of environmental law, he has represented the interests of Atanor and is currently representing Shell Capsa in several cases on environmental damage related to its refinery in Dock Sud.
